Terms and Conditions for Pen Store Talents 2026
The competition and exhibition Pen Store Talents 2026 (hereinafter the “Competition”) is organised by Pen Store Sthlm AB, company registration no. 556797-0073 (hereinafter “Pen Store”). Entries are accepted during the period specified from time to time on the website accessible via link from https://pen.store/talents2026 (hereinafter the “Competition Period”). By participating in the Competition, the participant accepts these terms and conditions in their entirety.
1.) Participation and competition formatParticipation in the Competition requires the participant to purchase the entry kit provided by Pen Store. The number of entry kits is limited and Pen Store gives no guarantee of availability.
Each participant shall create one (1) original artwork exclusively using all and only the products included in the entry kit and produce the artwork on the enclosed paper panel.
2.) Submission of entries and deadlinesFor a valid entry, the following is required:
(i) the original artwork must be submitted physically in accordance with the provided instructions; and
(ii) a digital image of the artwork must be uploaded via the campaign page accessible through https://pen.store/talents2026.
Entries must be received by Pen Store no later than the end of the Competition Period. The participant bears full responsibility for ensuring that the artwork is received in due time. Pen Store accepts no responsibility for delays in postal services or transportation, whether caused by shipping providers, agents, technical disruptions, administrative errors, force majeure or any other circumstance. Entries not received in time may be disregarded at Pen Store’s sole discretion. Pen Store accepts no responsibility for loss, damage or delay occurring before, during or after transport.
The email address provided upon upload shall be deemed to identify the participant and shall constitute Pen Store’s primary means of contact.
Only one (1) entry per person and email address is permitted. In the event of multiple submissions, Pen Store reserves the right, at its sole discretion, to consider only one of them.
Participants must be registered residents in a country to which Pen Store delivers and must have reached eighteen (18) years of age at the start of the Competition Period or have obtained the consent of a legal guardian.
3.) Content restrictions and public environmentGiven that entries may be displayed in a public environment, the artwork must not contain text or symbols, political messages or misleading information, discriminatory, gender-stereotypical or objectifying elements, pornographic or sexual content, encouragement or promotion of the use of drugs, alcohol, tobacco or gambling/betting, references to violence or other harmful behaviour, encouragement of vandalism or other unlawful acts, commercial messages or trademarks, content infringing third-party intellectual property rights, or content that discredits, ridicules or otherwise offends any person, group or subject.
Pen Store provides no advance approval regarding compliance with these rules and retains the exclusive right to interpret, apply and assess compliance with the terms. Pen Store may, without providing reasons, reject entries and determine at its sole discretion whether an artwork shall be included in any exhibition, publication or further selection. Pen Store is under no obligation to communicate whether a specific artwork has been accepted, rejected or otherwise included.
4.) No obligation to publish or displayPen Store is under no obligation to publish, display, distribute or otherwise use submitted entries. Pen Store reserves the right, irrespective of reason and without prior notice or explanation, to refrain from exhibiting, publishing or using an artwork.
Pen Store shall not be liable for any decision not to publish or display an artwork and is not obliged to trace, locate, recover or otherwise manage submitted artworks.
5.) Public display and riskEntries may be displayed in public transport or other public environments. Pen Store assumes no responsibility whatsoever for what may occur to an artwork, including but not limited to wear, damage, alteration, removal or loss. Submitted artworks will not be returned.
6.) Participant responsibility and indemnityThe participant is fully responsible for ensuring that the artwork does not violate applicable law or third-party rights. The participant undertakes to indemnify and hold Pen Store harmless from any claim, demand, damage, cost or loss, including legal fees and court costs, arising from the content, publication or display of the artwork.
Under no circumstances shall Pen Store be liable for consequences arising from the public exposure of the artwork.
7.) Jury procedure and prizesWinners are selected by a jury appointed by Pen Store. The jury shall appoint one (1) first prize winner and nineteen (19) additional winners.
The first prize consists of products available for purchase at Pen Store at the time of the award, with a total value of EUR 4,750 including VAT. The remaining winners shall receive products with a value of EUR 100 including VAT per winner.
Prizes are awarded in the form of credit to the winners’ customer accounts with Pen Store. Credit may only be used for products available at the time of redemption, is personal, non-transferable and cannot be exchanged for cash.
Prize credit must be redeemed within six (6) months from notification by email. The right to the prize shall lapse if the winner fails to take the necessary steps to redeem the credit within this period. After expiry of this period, all claims to the prize shall cease without compensation.
Any prize tax or other tax or levy arising as a result of winning shall be borne by the winner in accordance with applicable legislation in the country where the winner is tax resident or otherwise liable to tax. Pen Store is not responsible for withholding, reporting or paying such taxes unless required by mandatory law.
Jury decisions are final, non-appealable and need not be justified. Pen Store shall not be held liable for the jury’s assessments or decisions.
8.) Copyright and licenceCopyright in the artwork remains with the creator. By participating, the participant grants Pen Store a non-exclusive, royalty-free and perpetual licence to display, publish, market and use the artwork within the scope of Pen Store’s business in digital and printed media. This licence also includes the right, to a reasonable extent, to adapt, crop, format or otherwise technically process the artwork as necessary for publication, presentation or marketing purposes.
9.) Limitation of liabilityPen Store shall not be liable for direct or indirect damages, losses, costs or loss of profit arising in connection with participation in the Competition. This includes, but is not limited to, loss or damage to artworks, technical failures, delays, communication issues and decisions or actions taken by cooperation partners. The limitation of liability applies to the fullest extent permitted by applicable law.
10.) Force majeurePen Store shall not be liable for delays, cancelled exhibitions or other impact on the Competition resulting from circumstances beyond Pen Store’s reasonable control, including but not limited to governmental decisions, operational disruptions, strikes, technical obstacles, force majeure or decisions by cooperation partners.
11.) CommunicationBy participating, the participant agrees that Pen Store may communicate information regarding the Competition via the provided email address.
12.) Governing law and disputesThese terms shall be governed by and construed in accordance with Swedish law. Any dispute arising out of or in connection with the Competition or these terms shall be settled by Swedish general courts, with Stockholm District Court as the court of first instance.
13.) Amendments and prevailing languagePen Store reserves the right to correct errors and amend these terms if necessary. The applicable terms are available via link from https://pen.store/talents2026.
This English version is a translation of the original Swedish terms and conditions. In the event of any discrepancy or need for interpretation, the Swedish version shall prevail.
